Do your HR processes provide adequate protection when staff breach CQC standards or safeguarding?

The field of employment law can be a tricky one to navigate and mistakes can be very costly to businesses.  Where budgets are often already stretched, an expensive claim or fine can ruin a business, financially or by reputation.

H recently handled a case where a Care Worker was found to be falsifying care documentation.  A resident had fallen and broken her leg.  She was admitted to hospital, along with her individual care documentation.  It was found that this had been completed in advance of actual events and so the medication and fluid intake records were inaccurate.  The matter was reported to the Safeguarding Team and CQC was informed.

H advised his client to suspend the employee while a full investigation was conducted.  The worker was subsequently dismissed for gross misconduct.  The client could dismiss in the knowledge that all aspects of the process had been handled compliantly to avoid any risk of later legal action from the ex-employee.
